Vioxx, the anti-inflammatory drug approved by the FDA in 1999 for the treatment of chronic or acute pain ─ including pain from arthritis ─ was withdrawn from the market worldwide in late 2004 due to the increased risk of heart attack and stroke. Since then, more than 100 class actions and thousands of individual lawsuits have been initiated against Merck, which had initially planned to litigate each of the cases individually.
In November 2007, however, Merck agreed to pay a $4.85 billion settlement for Vioxx victims. The settlement is expected to put an end to the tens of thousands of lawsuits that Merck is facing over Vioxx. The company did not admit to any wrongdoing in the settlement, which was reached at the urging of the courts where thousands of Vioxx cases were pending.
